All applications to the UK Home Office are considered on their individual merits and in line with the Immigration Rules. I am aware that the removal of Mrs Cothill has since been postponed to allow the family to provide further evidence.
However it is important to note that the Immigration Tribunal had previously found that there was no reason Mrs Cothill could not be removed to South Africa, and that her health had not deteriorated significantly since her arrival in the UK. The Upper Tribunal also found that Mrs Cothill and her daughter conspired in Mrs Cothill's entry as a visitor by deception and sought to circumvent United Kingdom immigration law. Similarly it also agreed that there were no issues over Mrs Cothill's ability to re-integrate in South Africa, while the tribunal also criticised her access to the NHS treatment which she is not entitled.
